May 13 – Daily news from the red-shirt rally at Ratchaprasong

RATCHAPRASONG, MAY 13, 2010: United Front for Democracy Against Dictatorship (UDD) core leader Jatuporn Prompan has called on the Thai Army to return to its barracks saying the orders under which they have been deployed by Thai Prime Minister Abhisit Vejjajiva are illegal.

จตุพร พรหมพันธุ์  ร้องขอให้ทหารกลับเข้าสู้กรมกอง เพราะว่าคำสั่ง ให้ทหารมาสลายการชุมนุมนั้น ผิดกฏหมาย

“This is another illegal act by the illegitimate Abhisit government and if the army continues to remain on the streets and deploy against the red-shirt demonstrators their actions amount to nothing short of a coup d’état.

นี่เป็นการกระทำที่ผิดกฏหมาย อีกครั้งหนึ่งของรัฐบาล ถ้าทหารยังออกมาบนถนนเพื่อมาสลายการชุมนุมของคนเสื้อแดง  นี้เป็นการกระทำที่เกินกว่าเหตุ และเทียบเท่ากับการทำรัฐประหาร

Claiming the Thai government has no legal charter to deploy troops against the red-shirts peaceful protest, Mr. Jatuporn said the governments powers to institute a state of emergency (SOE) were removed following the 2006 coup that ousted prime minister Thaksin Shinawatra.

รัฐบาลไม่มีอำนาจตามกฏหมาย ในการนำทหารมาอยู่บนถนน ในการต่อต้านการชุมนุมอย่างสงบของคนเสื้อแดง การที่รัฐบาล ใช้อำนาจประกาศพระราชกำหนดฉุกเฉิน ซึ่งเป็นกฏหมายที่ได้ถูกถอดถอน โดยการทำรัฐประหาร เมื่อปี 2549

Mr. Jatuporm said: “the power enabling the government of the day to implement a SEO were enshrined in the 1997 constitution. The coup-makers of 2006 threw out this constitution and replaced it with their own in 2007 and this new constitution contains no provisions for a government to declare a SOE.

อำนาจในการประกาศพระราชกำหนดฉุกเฉินนั้นมีอยู่ในรัฐธรรมนูญ ปี 2540   การรัฐประหารในปี 2549 ได้ร่างรัฐธรรมนูญฉบับปี 2550  ขึ้นมา และโยนรัฐธรรมนูญปี 2540 ทิ้ง และนอกจากนี้รัฐธรรมนูญ มิได้บรรจุกฏหมายให้รัฐบาลสามารถประกาศใช้พระราชกำหนดฉุกเฉินได้

Mr. Jatuporn said the matter had already been raised by the Phue Thai Party and the UDD, and legal proceedings commenced.

ซึ่งเรื่องนี้  พรรคเพื่อไท และ นปช ได้นำเข้ากระบวนการทางฏฏหมาย

“On April 20 two lawyers acting on behalf of the UDD filed a motion in the Thai Administrative Court challenging the governments power to declare a SOE. The Administrative Court granted the petition and forwarded the case to the Constitutional Court for a ruling.

วันที่ 20 เมษายน  นปช ได้แต่งตั้ง ทนายความ 2 คน  ให้ยืนฟ้องต่อศาลปกครองในการใช้อำนาจของรัฐบาลที่ไม่ถูกต้องในการประกาศพระราชกำหนด และศาลปกครองได้รับคำร้อง และขณะนี้ได้ส่งเรื่องไปยังศาลรัฐธรรมนูญเพื่อพิจารณา

“Normal legal standards dictate that the actions of the government should cease until the Constitutional Court delivers a ruling on the ability of the government to declare a SOE. Abhisit and his cabinet are fully aware that their current actions in declaring a SOE are illegal, yet they insist on proceeding.

ตามกระบวนการทางกฏหมายรัฐบาลจะมีสิทธิ์ในการใช้ พระราชกำหนดฉุกเฉินก็ต่อเมื่อได้รับคำสั่งจากศาลรัฐธรรมนูญแล้ว  นายอภิสิทธิ์ และคณะ ก็ทราบการใช้การประกาศพระราชกำหนดฉุกเฉิน เป็นสิ่งที่ผิดกฏหมาย แต่ก็ยังยืนยันที่จะทำ

“Abhisit labels the red-shirts as terrorists and calls our protest illegal, yet it is actually him and his cabinet who are acting illegally by dispatching armed troops and war weapons onto the streets of Bangkok against protesters armed with bamboo sticks and plastic water bottles.

อภิสิทธิ์  ใส่ร้ายคนเสื้อแดง ว่าเป็นผู้ก่อการร้าย  และมาชุมนุมโดยผิดกฏหมาย  แท้ที่จริงแล้ว  นายอภิสิทธิ์เป็นพวกที่ทำผิดกฏหมายเสียเอง โดยการนำทหารที่มีอาวุธครบมือ มาปราบประชาชน ที่มีเพียงแค่กระบอกไม้ไผ่ และขวดพลาสติก

Today is day 59 of the red-shirts pro-democracy protest against the government of Prime Minister Abhisit Vejjajiva and the 39th day protesters have occupied the Ratchaprasong shopping precinct in the heart of Bangkok.
